I can't really afford to drop that kind of cash on an iphone. Plus the monthly service is pretty expensive where I live.

Did you still have some warranty time left? Did you keep all the papers for this warranty to apply? Do you still have the slip from the store where you bought your old iPod (online stores send slips with their products too)?

I can only say for certain about Sweden (since I rarely buy electronics from abroad), but it sounds like you're not the one who's supposed to pay for your new iPod. It's either the company from where you bought your old iPod (in Sweden, you have two years time to demand adequate replacement of equal value to the product you bought if you find any manufacturing errors on the old product within this time limit. And burden of proof falls on the company within this time.). Or it's the company that produced the product in question (manufacturers warranty can extend to longer periods of time than the store's warranty, whereas the manufacturer's either have to repair or replace the faulty product).

My advice to you, read up on consumer's rights in your region and/or consult a lawyer who handles consumer's issues on how you can pursue this (just asking a question is usually free).

I'm not saying you should pursue this legally. I just think that if you play your cards right, you can bill either Apple or the store you bought your old iPod from by sending them a letter and simply telling them that you've been in contact with lawyers and so on.

But (here comes the but), this procedure works in Sweden where consumers have rights and there are heavy laws that help the consumers. I'm not sure how this works in other countries, or if it works at all. You might even have to threaten with exposing this to the media. The question is, how much trouble are you willing to go through for perhaps unsatisfactory results?

Here's a copy of their terms of use... I'm trying to figure out how I violated them..

Submissions
Stay on topic. Apple Discussions is here to help people use Apple products and technologies more effectively. Unless otherwise noted, do not add Submissions about nontechnical topics, including:
Speculations or rumors about unannounced products.
Discussions of Apple policies or procedures or speculation on Apple decisions.
Be polite. Everyone should feel comfortable reading Submissions and participating in discussions. Apple will not tolerate flames or other inappropriate statements, material, or links. Most often, a "flame" is simply a statement that is taunting and thus arbitrarily inflammatory. However, this also includes those which are libelous, defamatory, indecent, harmful, harassing, intimidating, threatening, hateful, objectionable, discriminatory, abusive, vulgar, obscene, pornographic, sexually explicit, or offensive in a sexual, racial, cultural, or ethnic context.
Post constructive comments and questions. Unless otherwise noted, your Submission should either be a technical support question or a technical support answer. Constructive feedback about product features is welcome as well. If your Submission contains the phrase “I’m sorry for the rant, but…” you are likely in violation of this policy.
Do not post polls or petitions or links to same.
Test your answer. When possible, make sure your Submission works on your own computer before you post it.
No advertising. Do not use the Site to sell or market your products to others and do not post a URL unless it directly answers a user’s question. If any portion of your Submission, including any posted URL, results in any accrual of compensation or benefit to you, you must note this in your post by stating, “I may receive some form of compensation, financial or otherwise, from my recommendation or link.” As well, the following are not allowed:
A submission created solely to advertise a book, service, software or some other item for sale.
Any reference, including a link, to a commercial item that is not directly related to a relevant technical support question or answer. For example: “This post created by Super Post Creator.”
You may sign your Submissions with information about yourself. However, this should not include a link to a website. An example of an acceptable signature:
Justine R.
Author, “Apple Lisa Communities: Tips and Tricks”
No inappropriate user names (“Aliases”) or impersonations. Inappropriate or offensive user names or aliases will be removed and persons attempting to impersonate another user will be removed. User names may not contain website, email addresses or other contact information.
Keep within the Law
No material may be submitted that is intended to promote or commit an illegal act.
Do not submit software or descriptions of processes that break or otherwise ‘work around’ digital rights management software or hardware. This includes conversations about ‘ripping’ DVDs or working around FairPlay software used on the iTunes Store.
Do not post defamatory material.
Material submitted must be your own work or work to which you have a license. You warrant and represent that you own or otherwise control all of the rights to the information contained in your Submission.
License to Use Submission. By sending a Submission to the Site you agree to grant Apple a perpetual, royalty-free, non-exclusive worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to the Submission. If you do not want to grant to Apple the rights set out above, do not send your Submission to the Site.

Unless they are saying that I was posting Defamatory material by pointing out that all these people's ipods have died after using their new updated itunes!

It's pretty obvious they just want to make this problem disappear, but how can they pretend they're not a big money-hungry organization when they won't fix their own mistake?

Here's the post that Apple deleted:

Has anyone else had their Ipod die recently after updating itunes? Add you name to the list below. I was quite concerned I had to buy a new Ipod, but after seeing thier mistake kill so many, I'm pretty sure they will have to correct this problem (what a shame if the press got ahold of it, imagine the damage to stock prices that are already wobbly). Add your name to the list (which is begining to look like a class-action-sized group!)

da33a9
zapymax
litebeam
kip sanford
junyr
Jimbo88
Nbke3k1
Imstartingtohat…
Evaz
Sfdevil
Sadako (hasn’t tried restore yet)
Valfar
Vernod (charged and told it can’t be fixed)
Chequers
RorySMiller
Jkgandfjghd
Dface19 (although he admits he left his in 45 degree car)
Lock-down
SuckerSpawn (still shows apple icon but nothing else)
Confuzzy
Cdrw (at least once it came back from the dead, then died again)
Queenofhearts8806
Andrewn5656
Colleen730
Klewis1127

non-bricked problems (mainly constant restart or loud clicking on restart)
Go My Heaven
Vtr_racing
Dbaseball (apple repair told him nothing was wrong)
